A Workers' Compensation claim arises when a person suffers an injury while on the job or contracts an occupational disease. If as a result of a workers' compensation claim a person loses time from work, has medical expenses, or suffers a permanent disability, he has a right to be compensated. There are many issues that can arise as a result of a workplace accident.

Social Security Disability benefits are available to people who have serious injuries or medical conditions that prevent them from working. If a person has earned sufficient social security credits, he is eligible to apply for social security disability. In order to demonstrate that a person meets the requirements to be awarded benefits it is often in the best interest of the claimant to retain an attorney to represent them from the beginning of the claim and through any hearings and appeals. Virginia Retirement System disability benefits are available to some public employees who have become disabled permanently from doing their job. A person who does not have enough time in service to qualify for a reasonable retirement benefit may have a substantially larger disability retirement benefit available. In most Virginia Retirement disability claims there are both medical and vocational issues that must be considered and properly presented. In many cases deserving workers are turned down simply because the medical disability was not fully and properly presented in a way that the Medical Review Board could understand. It is usually best to have legal representation before the initial claim is filed, otherwise it may be more difficult to win a claim through the appeals process.
